The reinstatement of the judicial duty and on claims at multimember first instant court

The reinstatement of the judicial duty and on claims at multimember first instant courts provides an amendment tabled and voted on in the mediation bill.
In fact, the new provision will also apply to pending claims, for which the first hearing is held after January 1, 2020, as well as to lawsuits that have been held before the law is published.
This change was pushed forward by a late amendment.
The proposed provision provides in detail:
- Article 7, par. 3 of Law 1544/1942, as replaced by Article 70 of Law 3994/3022, Article 21 of 4055/2012 and Article 33 of Law 4446/2016, shall be replaced by the following:
The actions for all disputes at county courts and single-member first instant courts, as well as actions for the elimination of mortages and cancellation of auction are not subject to the judicial duty. - The provisions of the preceding paragraph shall also apply to pending claims for which the first hearing is held after 1 January 2020 and to lawsuits that have been held before the law is published.
